What is a Compulsory Purchase Order?

A Compulsory Purchase Order is issued by either Central or Local Government or other organisations which have a statutory right to acquire property. To exercise such rights, the applicant (the organisation) must meet set criteria as laid down by statute. In particular, the authority must prove the purchase is in the public interest. The Applicant is encouraged to liaise with the owner in the first place rather than attempting to acquire by compulsion. Only when an agreement cannot be reached will the applicant be able to move forward with a Compulsory Purchase Order.
